MK allows political rally in educational facilities as long as no party attributes are displayed

Jakarta, IO – The Constitutional Court (MK) allows election participants to carry out campaigns in government and educational facilities on the condition that no political party attributed are on display.

This rule was stipulated in the MK Decision 65/PUU-XXI/2023 which was read out on Tuesday (15/8), per Kontan, Monday (21/8).

“Government facilities, places of worship, and educational institutions can be used if election participants attend without campaign attributes at the invitation of those in charge of those venues,” read the decision.

A number of parties have criticized the exception as regulatory inconsistency with regard to Law 7/2017 on elections which expressly forbids campaign on places of worship and education.

MK stated that this part of the explanation had no binding legal force because it created ambiguity. Instead, the exception is included in the main norm of Article 280 (1h) of the Election Law, except for “places of worship.”

In its legal consideration, the MK noted that this exception was also stipulated in the previous election law. (un)
