KPK: Wealth Reportmandatory for Regional Head Candidates

IO – The Corruption Eradication Commission (Komisi Pemberantasan Korupsi – “KPK”) requires all Candidate Regional Heads who are participating in the 2020 Regional Elections to report the extent of their wealth as quickly as possible. This requirement also applies to Candidate Regional Heads who are originally not members of the State Administration. “KPK requests Candidate Regional Heads to start submitting a report of their wealth to it, especially if they are not a State Administrator or who are reporting their wealth for the first time. The latter are included in the special report category,” said KPK Acting Spokeswoman for Prevention (of Corruption), Ipi Maryati, on Monday (31/08/2020). 

KPK will continue to expedite Candidate Regional Heads who are reporting their wealth, because the State Administrator Wealth Report (Laporan Harta Kekayaan Penyelenggara Negara – “LHPKN”) is a mandatory requirement for Regional Head candidacy according to the Law. “In accordance with the mandate of Law Number 10 of 2016 concerning the Election of Governors, Regents, and Mayors and the Law Number 11 of 2006 concerning the Government of Aceh, a receipt of LHKPN submission is an administrative requirement in the election for governors, regents, and mayors,” Ipi said. 

Concerning this requirement for candidacy, KPK has issued a technical guidance for submitting the Wealth Report and for issuing the receipt for it, i.e. the Circular of the Head of KPK Number 07.1 of 2020 dated 31 March 2020. The Circular regulates that, first, the LHKPN must be submitted online through the elhkpn.kpk.go.id website. Second, KPK will only issue a receipt for any submitted LHKPN that it has verified completely. Third, the LHKPN receipt that can be used as an administrative requirement for participating in the Regional Elections is the receipt KPK issued for LHKPN submitted online through the elhkpn. kpk.go.id website from 1 January 2020 to the final day for correcting the Candidate’s administrative requirement document, whether in terms of periodic or special reports. “In order to support the smoothness of the process, KPK reminds all Candidate Regional Heads to submit LHKPN within the candidacy requirement document correction period and/or grace period for candidacy requirements as regulated in the current KPU Regulation. This is meant to ensure that the Candidate has sufficient time to verify their documents and/or to complete any lack,” Ipi said. 

Ipi then detailed how to fill in the online or e-LHKPN. Candidates who have not created an LHKPN e-filing account must first register by filling in and signing the e-filing form. The form can be obtained through the elhkpn.kpk.go.id website in the “Download” menu. The completely filled form must then be signed manually using pen and ink. Afterwards, it must be sent to KPK’s Directorate of PP LHKPN at Gedung Merah Putih KPK, Jalan Kuningan Persada Kav. 4, Setiabudi, Kuningan, South Jakarta 12950 along with a copy of the Citizen’s e-ID card. 

“When they have created an e-filing account, the Candidate can start filling in the LHKPN online. They will then be requested to send a Power of Attorney on behalf of themselves, their spouses, and their dependents who are 17 years of age or older to KPK by post. The Candidate downloads and prints individual Powers of Attorney on behalf of these names, who must then sign them on a IDR 6,000.00 duty stamp,” Ipi said. 

KPK will then perform an administrative verification of the LHKPN that they received. This verification includes correctness of the data filled in the LHKPN, the completion of the activation form, and the Power of Attorney. If the LHKPN is found to be properly completed, KPK will issue the LHKPN receipt to the relevant person. However, if it is found to be incomplete, KPK will issue a notice to the Candidate about any parts that need to be corrected and/ or completed. LHKPN correction must be completed within at most 14 (fourteen) calendar days from the time the Candidate receives the advisory. 

If the Candidate fails to correct and/or complete the LHKPN within the stipulated time frame, KPK will still issue the receipt with an “Incomplete” Verification Note according to applicable regulations. “The LHKPN receipt acceptable as a requirement for candidacy as a governor, regent, or mayor is the one with the QR code that signifies that it is really issued by KPK,” Ipi said. 

The 2020 Simultaneous Regional Elections will be the biggest simultaneous electoral/political contest throughout Indonesian history, with 270 regions participating at the same time. There were doubts whether we can actually hold Simultaneous Regional Elections or not due to the current condition of Coronavirus (COVID-19) pandemic. However, the Government and Commission II of the House of Representatives finally officially approved the plan to hold the 2020 Simultaneous Regional Elections on 9 December 2020. (dan)
