MA Issues Circular Letter Prohibiting Courts from Approving Interfaith Marriages

Jakarta, IO – The Supreme Court (MA) issued Circular 2/2023 prohibiting the court from granting favorable ruling to interfaith marriages, per Kompas, Wednesday (19/7).

This circular letter was issued by MA legal and public relations head Sobandi and signed by Chief Justice Muhammad Syarifuddin. It aims to provide certainty and consistency in the application of law among adherents of different religions concerning interfaith marriage.

The judges are asked to use the guidelines stipulated by the applicable law. First, a legal marriage is a marriage that is carried out according to the laws of each religion/faith.

This is in accordance with the provision of Article 2.1 and Article 8.f of Law 1/1974 on marriage. Thus, the court was asked not to grant approval to the registration of marriages between people of different religions/faiths.

The circular has been forwarded to the MA judicial and non-judicial affairs deputy chairs and the chair of MA chamber, as well as its echelon one officials. (rr)
