Health Law – KLB no longer linked to politics

Jakarta, IO – Following the ratification of Law on Health Number 17 of 2023 on July 11, 2023, the government is preparing to draft derivative regulations for its implementation. This was carried out openly and transparently, involving the widest possible public participation. Public Hearing of the Draft Government Regulation (Rancangan Peraturan Pemerintah-RPP) concerning Implementing Regulations of the Health Law, is the government’s effort to fulfill the public’s right to be heard, the public’s right to have their opinions considered, and the public’s right to receive an explanation of the substance of the RPP. 

Since Monday (18/9/2023), public hearings on the RPP have been conducted, both offline and online, to acquaint the public with the regulations established by the Health Law. “We are currently holding a public hearing in the community to socialize [the Health Law],” said Deputy Minister of Health, Prof. dr. Dante Saksono Harbuwono, Sp.PD-KEMD, Ph.D. 

Health Law fields managed by the Directorate General of Disease Prevention and Control cover 18 Articles covered by Government Regulations, grouped into seven main regulatory substances, including Extraordinary Events (Kejadian Luar Biasa-KLB) and Outbreaks, Matra Health, Management of Non-Communicable Diseases, Vision and Hearing Health, as well as Suppressing Addictive Substances such as Tobacco Products and Electronic Cigarettes. In dealing with outbreaks and epidemics, the Health Law regulates collaboration between local governments and other stakeholders, including tracing, testing, and treatment. 

“Implementation of outbreak and epidemic management includes coordination and cooperation with various related parties, including national and international health authorities, government agencies, non-governmental organizations and the community, to carry out a coordinated and effective response to KLB/outbreaks, so that no more KLB/outbreaks will be linked to political conditions,” said Secretary of the Directorate General of Disease Prevention and Control of the Ministry of Health, dr. Yudhi Pramono, MARS, in Jakarta, Tuesday (19/9/2023).

Improve Physical and Mental Health 

Meanwhile, the Director of Health Surveillance and Quarantine Ministry of Health, dr. Ahmad Farchanny, MKM, said that the RPP, which regulates the provisions related to the implementation of land, sea, and air health services, is stipulated in Article 108 as a comprehensive aim to improve the physical and mental abilities of individuals and groups to adapt to the environment, in facing a continuously changing situation. Matra Health is a special effort organized to achieve the highest level of health in a shifting material environment, on land, at sea, or in the air.

“The operational definition of Matra Health and its types needs to be regulated more clearly, because Matra Health is a program reverted to the Ministry of Health, so opinions and input from various experts are needed to adjust it to conform to current conditions,” said dr. Farchanny. 

In the public hearing for the RPP on the substance of KLB, outbreaks, and Matra Health, the Ministry of Health received constructive input, especially regarding the criteria and procedures for determining KLB/ outbreaks, activities to deal with KLB/outbreaks, and the scope of Matra Health. As of this writing, public hearings are still ongoing with other topics. (est)
