Wamenkumham: Don’t get trapped in logical fallacy, articles on insult to president is special!

Jakarta, IO – Law and Human Rights deputy minister Eddy OS Hiariej confirmed that the ministry would not remove the articles on insults to president in the penal code law draft (RKUHP). According to him, those who said the article are anti-criticism are people with “logical fallacy.”

“They can’t distinguish between criticism from insult. What is prohibited is insult, not criticism,” Eddy told CNN Indonesia on Wednesday (29/6).

He assured that the articles do not refer to other countries’ laws because, he said, they are special. Eddy explained that the articles are categorized as “mala in se” or an act that is found to violate morality rules set forth by a society.

Meanwhile, other countries, especially western countries, categorize it as “mala in prohibita” or wrong because it is prohibited in a legislation.
