Insulting the president now an offence that warrants complaint on RKUHP

“The change is that complaints are to be made in writing by the president and vice president,” he said.

Previously, MK through Ruling 013-022/PUU-IV/2006 annulled article on insulting the president and vice president in the Penal Code. The Court viewed that Article 134, Article 136, and Article 137 of the Penal Code could create legal uncertainty because their interpretations were probe to manipulation.

In RKUHP, the perpetrators can be sentenced to a maximum of 3.5 years in prison. If the insult is carried out through social media or electronic means, they can serve up to 4.5 years jail term.

“Every person who publicly attacks the honor or dignity of the President or Vice President shall be sentenced to a maximum imprisonment of 3 (three) years and 6 (six) months or a maximum fine of category IV,” reads Article 218(1).
