Deemed unconstitutional, Job Creation Perppu challenged at MK

Jakarta, IO – Several civil society groups consisting of students, lecturers and advocates have filed a judicial review against the Government Regulation in lieu of Law (Perppu) 2/2022 on Job Creation to the Constitutional Court (MK), Thursday (5/1), reported CNN Indonesia.

“Today, January 5, 2022, at 2pm WIB, I, Viktor Santoso Tandiasa, who represents the petitioners, will register an application for formal review of the Government Regulation in lieu of Law 2/2022 on Job Creation,” said Viktor.

Viktor said the group wished to review the legality of the Perppu against the 1945 Constitution and other regulations, including Law 12/2011 on establishment of laws and regulations as amended by Law 13/2022 on the second amendment to Law 12/2011, Decision 138/PUU-VII/2009 and Decision 91/PUU-XVIII/2020.

President Joko Widodo earlier issued a Job Creation Perppu to replace the Job Creation Law which had been declared conditionally unconstitutional by MK in a November 2021 ruling.

According to the government, the Perppu was issued due to urgent global economic situations, including the impact of Ukraine war. Nevertheless, it has been rejected by many parties because its contents were deemed detrimental to the interest of workers and the environment. (un)
